Marjorie’s Message
Hey there!
As you may already know, every newsletter I like to share a little personal touch, a slice of my journey, an episode from the novel of my life. Today, I thought I’d answer a question that has bubbled up a few times, especially on my beloved Instagram – “How did a girl from Brazil find her way into the heart of American law?”
Born and educated in Brazil, my early years were saturated with the deep-rooted laws and customs of my home country. But after completing my studies, I felt a pull towards the USA—a pull many of you might understand. The thrill of a new beginning, mixed with the jitters of the unknown, was something I felt deeply.
Even with a law degree from Brazil a lot of people are surprised to learn that my journey of becoming an attorney in the U.S. was no straightforward feat. I found myself starting from scratch, re-enrolling in law school, and facing the challenges of cultural adjustments and rigorous academic demands all over again. I navigated through years of night school while working during the day as a law clerk and paralegal for different firms.
But life is filled with lessons, both in school and out. A surprising lesson? The power of buying used books to save money! It might sound simple, but it’s a great example of how small choices can make a big difference for both our wallets and our wisdom.
Every journey has its share of bumps and stumbles. In my first week of law school, we were told to look to the student standing to our left and to our right, with the ominous warning that many of us wouldn’t see the finish line. True to word, many didn’t, but I did. And that journey, and my relentless drive, has shaped me.
My path as an attorney has taught me more about life than any book or class ever could. I’ve learned the power of self-reliance and believing in myself, the value of hard work, and the magic of perseverance. And after gaining vital experience from other firms, almost ten years ago, I decided to brave the waters of starting my own practice. It was a leap, an endeavor that requires wearing countless hats. But it has been, without a doubt, the most fulfilling decision of my professional life.
Reflecting on my journey, I’ve discovered that life, like law, is about balance. Balance your work with your passion, your ambition with humility, and always, always give more than you take. I firmly believe that what you put into the Universe, returns to you threefold. The real success is in recognizing and appreciating the small things – a sunrise, a cup of tea, a loving moment with your pet or a loved one, a sincere smile from a stranger, the smell in the air just before the rain falls, a sunset, the beauty of your own reflection in the mirror, however imperfect it may be, the gratitude for being healthy and able to try again every morning, the list is as long as your imagination…
Wrapping up my little trip down memory lane, I thank you for your continued trust, friendship, and the shared journey. Here’s to more stories, more successes, and the beautiful dance of life. Until our next ‘Marjorie’s Message’, stay safe and keep striving.
Warmly,
Marjorie Brunelli, Esq.

Navigating Prenuptial and Postnuptial Agreements in Florida
What Are They? Do You Need One?
Over the years in my practice, I’ve observed an increasing number of individuals and couples keen to understand the nuances of prenuptial and postnuptial agreements in Florida. Our beautiful Sunshine State, with its unique legal landscape, presents certain specifics that I’d like to dive into today.
Prenuptial vs. Postnuptial: At the core, a prenuptial agreement is a proactive step taken before marriage. It’s a roadmap that outlines the division of assets, properties, and responsibilities in the event of a divorce or death. Conversely, a postnuptial agreement is established after the wedding vows, often in response to changing circumstances.
Florida law provides a robust framework for these agreements. They are enshrined in the Florida Statute §61.079, known as the “Uniform Premarital Agreement Act.” However, for enforceability, the document must be entered voluntarily and should be devoid of any fraudulent intent.
Why Consider Such Agreements in Florida?
Given the diverse financial, familial, and personal landscapes of our state’s residents, here are expanded reasons to contemplate these legal safeguards:
Varied Financial Landscapes: Florida, being a hub for both retirees and entrepreneurs, often sees couples with significant wealth disparities. Prenups can eliminate financial ambiguities.
Second Marriages & Blended Families: With prior obligations to children or spouses from previous marriages, a prenup can streamline responsibilities.
Florida’s Flourishing Business Scene: If you’re part of Florida’s dynamic business community, shielding your enterprise from marital complexities is prudent. Ensure that your business remains a separate entity.
Estate and Legacy Protections: From family properties in Miami to cherished heirlooms passed through generations, it’s essential to ensure they remain intact.
Tackling Debts: With student loans and mortgages being common concerns, protect yourself from being accountable for your partner’s debts.
Taking Career Pauses: In families where one partner decides to halt their career, particularly for child-rearing or other personal reasons, an agreement can safeguard their financial interests.
Security for All: Financial stability isn’t the sole domain of the wealthy. Agreements can be tailored to protect both partners, regardless of their current financial stature.
Respecting Estate Plans: With Florida’s unique estate laws, prenups and postnups can serve as tools to make sure your estate plans stand firm against challenges.
Dynamic Changes Call for Postnuptials: Relationships and life scenarios evolve. Whether it’s a significant financial windfall, birth of a child, or change in career, postnuptial agreements allow couples to adapt to new financial landscapes.
