Marjorie’s Message
Hello there!
I hope this message finds you all in great spirits! Today, I want to share a special story, a recent adventure that brought a renewed sense of vitality into my life. After 14 long years, I finally took a two-week vacation! And let me tell you, it was nothing short of incredible!
Dear Friends and Colleagues, This was my first time traveling to Europe. Its irresistible charm, diverse culture, mouthwatering cuisine, breathtaking landscape, and unbelievable ancient history left me speechless. From the sun-drenched beaches of Greece to the bustling streets of Rome, together with all the monuments, ruins, works of art, and the richness of an era long behind us … I was left in awe at every step and every turn. My words just cannot do it justice, but this experience has left an undeniable mark on my soul!
My main destination was an island paradise in the Greek Isles, by the name of Serifos. It was here I embarked on a yoga retreat. Picture unrolling your yoga mat and overlooking the boundless expanse of the Aegean Sea bathed in the warm glow of the sun. With a gentle breeze, I delved into the ancient practice of yoga, feeling a profound sense of calm, peace, and clarity.
As I now return to the familiar rhythm of my legal practice, I carry within me the invaluable lessons learned during this transformative adventure and I am reminded of how immensely grateful I am for the trust you have placed in me and the support you have shown.
The message I want to leave you with today is that true success lies not only in professional achievements but also in the delicate art of finding balance. Sometimes the best and most effective action is inaction, as rest allows for clear-headed strategizing and patience allows the situation around you to reveal itself. Remember to celebrate the wonders of life once in a while, create memories through travel and unique experiences, and strive for that delicate equilibrium that fills your heart and soul.
With heartfelt gratitude and a renewed commitment,

Unveiling the Top Five Probate Questions I Get Asked the Most
Unveiling the Top Five Probate Questions I Get Asked the Most
When it comes to the probate process, I know it can feel like stepping into the unknown, especially if you have never dealt with the loss of a loved one before. As the designated Personal Representative in the decedent’s Last Will & Testament, you are bound to have some burning questions. So, let’s address the top five probate inquiries that most folks like you ask their trusted probate attorney (that’s me!).
1. Can I be the Personal Representative if I don’t live in Florida?
Now, don’t fret! Even if you are not a Florida resident, you can still take on the role of Personal Representative in probate. You qualify if you are a legally adopted child or parent of the decedent, a blood relative, the spouse, or a close family member like a sibling, niece, nephew, uncle, or aunt.
2. Does probate take years to wrap up?
Oh, I’m happy to debunk this one. Unless we’re dealing with a multi-million-dollar taxable estate, probates typically conclude within six months to a year. However, if we have to file a federal estate tax return for a taxable estate or if someone contests the Will, the process can drag on much longer.
3. Can I disinherit my spouse?
Florida law has a few safeguards for surviving spouses. Even if your spouse isn’t mentioned in the Will, they’re entitled to thirty percent (30%) of the estate, including probate and non-probate assets. Any exceptions? Well, yes, if you both signed a pre-nuptial or post-nuptial agreement, waiving those inheritance rights.
4. Can I sell the decedent’s home without going through probate?
Ah, the home sweet home. If the property was solely owned by the decedent, without a joint owner or designated beneficiary on the deed, we cannot rush into a sale until the court enters an order determining the rightful beneficiary. Patience is the name of the game here.
5. Do I have to pack my bags and head to Florida to be the Personal Representative?
Lucky for us, technology has come a long way! Nowadays, you can handle your duties as a Personal Representative from afar. But initially, we’ll need to pay a visit to the decedent’s home, identifying, gathering, and securing their assets.
